DHS Ends Automatic EAD Extensions: What Foreign Nationals Need to Know
The Department of Homeland Security (DHS) has announced a major policy shift that will affect many foreign nationals who rely on Employment Authorization Documents (EADs). Here’s a breakdown of what changed and how it may impact applicants.
What Changed?
- On October 29, 2025, DHS announced it is ending the practice of automatically extending certain EADs for foreign nationals who file timely renewal applications.
- Previously, eligible applicants received automatic extensions from 180 up to 540 days while their renewal application was pending.
- Under the new rule, issued as an interim final rule, this automatic extension benefit ends starting October 30, 2025.
What This Means Now
- Foreign nationals must receive formal approval of their renewal application and obtain the new physical EAD before their employment authorization is extended.
- Automatic extensions will no longer apply to renewal filings submitted on or after October 30, 2025.
Why DHS Made This Change
- DHS states the policy shift will improve:
- “Proper screening and vetting” of applicants
- Fraud detection and prevention
Limited Exceptions
The following situations are not affected:
- Automatic extensions previously issued before October 30, 2025
- Certain extensions provided:
- By law
- Through a Federal Register notice, including those related to Temporary Protected Status (TPS) documentation
Recommended Actions for Foreign Nationals
USCIS advises all applicants to plan ahead:
- File EAD renewal applications as early as possible, up to 180 days before EAD expiration
- If eligible, consider using premium processing to speed up adjudication
- Be aware that:
- EAD processing times fluctuate
- Premium processing or expedited requests are not available for many EAD categories
Expect Possible Employment Gaps
Despite early filing, some applicants may still experience temporary lapses in employment authorization because:
- Processing times are unpredictable
- Not all categories allow for premium processing
- Renewal must now be fully approved before authorization continues
